Terms of Service

These Terms of Service ("Terms") govern your access to and use of Panopt. (the "Service"), including the Panopt. browser extension and any related websites or software. By installing the extension or creating an account, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Panopt. is a browser extension that uses AI to generate descriptive alt text for images you encounter on the web. The Service sends image data to our servers, which process it using third-party AI models and return a suggested description. You are responsible for reviewing and, where needed, editing any generated alt text before publishing or sharing it.

2. Accounts

You must create an account to use the Service. You agree to provide accurate information and to keep your credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at support@usepanopt.com if you suspect unauthorized access.

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent or guardian's permission.

3. Subscriptions and Billing

Certain features require a paid subscription. Subscriptions are billed on a recurring basis (monthly or annually, depending on the plan you select). Payment is processed by Stripe. You authorize us to charge your payment method on each billing date.

You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period — you will retain access until then, and no further charges will be made. We do not issue prorated refunds for unused time except where required by law.

We reserve the right to change pricing with at least 30 days' notice. Continued use of the Service after a price change takes effect constitutes your acceptance of the new pricing.

4. Acceptable Use

You agree not to:

• Use the Service to process images you do not have the right to analyze or reproduce.
• Attempt to reverse-engineer, scrape, or extract data from the Service beyond normal use.
• Use the Service to generate content that is misleading, harmful, or violates any applicable law.
• Circumvent usage limits or share account credentials with others.
• Interfere with the Service's infrastructure or security.

We reserve the right to suspend or terminate accounts that violate these restrictions.

5. AI-Generated Content

Alt text generated by the Service is produced by AI models and may be inaccurate, incomplete, or inappropriate for your specific context. We make no warranty that generated descriptions are correct or suitable for any purpose. You are solely responsible for reviewing, editing, and publishing any content derived from the Service, including for accessibility compliance.

6. Intellectual Property

The Service, including its software, design, and branding, is owned by Panopt. and protected by intellectual property law. You receive a limited, non-exclusive, non-transferable license to use the extension for personal or internal business purposes.

You retain ownership of any images you process through the Service. By using the Service, you grant Panopt. a limited license to process those images solely to provide the functionality described herein. We do not sell or share your image data with third parties for advertising or training purposes.

7. Privacy

Our collection and use of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the practices described there.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the fullest extent permitted by law, Panopt. will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim will not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access for violation of these Terms, non-payment, or any reason at our discretion, with or without notice. Upon termination, your license to use the Service ends immediately.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice within the extension. Your continued use of the Service after the effective date of any update constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes will be resolved in the courts of Santa Clara County, California, and you consent to personal jurisdiction there.
